Account Information Automatically Collected

Customer Communications

Customers may subscribe to Syncly’s newsletters or other offers by opting-in on the Platform and providing their name, company name, and job title, email address, and phone number. Users can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us at support@syncly.us.

Account Information Provided By You

In subscribing to our Service, we require you to provide account-based information, including address, name, phone number, titles, roles, usernames, passwords, email, payment processing information, and other similar information. This information is necessary to facilitate account services and subscription and related purchases through the Platform. Account information may also be used to (i) provide information regarding our Service; (ii) communicate material changes to our Terms of Service and Privacy Policy; and/or (iii) help us maintain and improve services offered.

Log and Usage Data

Log and usage data is service-related, diagnostic, usage and performance information our servers automatically collect when you access our Services. We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent. We use personal information collected via our Service for a variety of business purposes. Syncly does not sell Personal Data collected through your use of the Platform with any third party. Information is collected to facilitate the Services offered or for internal analysis relating to product improvements. To facilitate account creation and login process

Syncly utilizes Google authentication services to facilitate secure access to our Service. Google authentication requires a user to input email, password and any additional required method of verification, such as a one-time temporary password for two-factor authentication. Users should review Google’s Privacy Policy for more information on their data collection and use practices.

To post testimonials

We post testimonials on our Website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update or delete your testimonial, please contact us at support@syncly.us.

Email Notifications

Syncly utilizes Amazon SES and Intercom to create and deliver user notifications from the Platform. Syncly shares its customer contact information, such as name and email address, to process that data. Users should review Amazon’s Privacy Policy and Intercom’s Privacy Policy for more information on their data collection and processing practices.

Notifications

Syncly utilizes Intercom and Slack to facilitate customer notifications. Users should review Intercom’s Privacy Policy and Slack’s Privacy Policy for more information on their data collection and use practices.

Customer Relationships Management

Syncly utilizes services provided by Salesforce, Inc. and HubSpot, Inc.to manage its customer relationships and the information and data associated with those customers. Account information, including personal information such as customer’s account name, email, phone, mailing address, etc. with Salesforce.com or Hubspot.com. Data is collected and utilized in accordance with Salesforce’s Privacy Policy and Hubspot’s Privacy Policy.

Servers

Syncly hosts customer and services data through Amazon Web Services and Google Cloud Platform. Customers should view the Amazon Privacy Policy and Google Cloud Privacy Policy for more information about their data collection and privacy policies.

Product Usage Data

Syncly utilizes Segment, Sentry, DataDog, Hotjar, and Amplitude to track product usage and error data to help us understand how users engage with our Platform, so that we can review and improve our Services. Customers should view the Segment Privacy Policy, Sentry Privacy Policy, DataDog Privacy Policy, Hotjar Privacy Policy, and Amplitude Privacy Policy for more information about their data collection and privacy policies.

Website Analytics

Syncly utilizes Google Analytics to access anonymized and/or pseudo anonymized data to help us understand website traffic. Google Analytics provides a report to us with website trends without identifying the Personal Data of individual users. Website visits are tracked using Google Analytics in accordance with Google’s Privacy Policy. However, if you decide to withdraw your consent to such data collection, you may opt-out by installing the Google Analytics Opt-out Browser Add-on.

Payment Processing Information

Syncly does not itself store debit or credit card information on its servers. Syncly utilizes a third party payment processor, Stripe, to manage and process payments in order to guarantee the security of your information. Customers should review Stripe’s Privacy Policy for more information on their data collection practices

Other Potential Third-Party Disclosures

Personal Data may also be disclosed to third parties (1) as required by law, such as to comply with a subpoena, or similar legal process; (2) when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request, or (3) if Syncly is involved in a merger, acquisition, or sale of all or a portion of its assets.

We will use commercially reasonable efforts to notify users about law enforcement or court ordered requests for Personal Data unless otherwise prohibited by law.

3. How Long Does Syncly Keep Your Information?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us to keep your personal information for longer than twelve (12) months past the start of the idle period of the user’s account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible, then we will securely store your personal information and isolate it from any further processing until deletion is possible.

4. Does Syncly Collect Information From Minors?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under the age of 18, please contact us at support@syncly.us.

5. How Can I Review, Transfer, Restrict the Use of or Request Erasure of Personal Data?

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account
  • Contact us using the contact information provided

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Service and/or comply with applicable legal requirements.

In addition, California law permits California-resident Customers to request and obtain from Syncly once a year, free of charge, certain information about their Personally Identifiable Information (as defined by California law) disclosed to third parties for direct marketing purposes in the preceding calendar year (if any). If applicable, this information would include a list of the categories of PII that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. All of our Customers, regardless of their U.S. residency or country of domicile shall have the right to request and obtain a copy of such information in accordance with applicable law.

Syncly shall provide a copy of requested Personal Data in a structured, commonly used and machine-readable format. Customers shall have the right to transmit such Personal Data to another service provider without restriction in accordance with applicable law.

6. What is Syncly’s Security Policy?

We have implemented reasonable administrative, technical and physical security measures to protect your personal information against unauthorized access, destruction or alteration.

All data is securely encrypted utilizing AES-256-bit encryption. Please review the AWS Cloud Security Policy for more information on AWS security practices. Syncly utilizes only PCI-DSS compliant third party payment processors to ensure the security of your personal information. 

Users should review Stripe’s Security Policy for more information on their security practices.

7. What Are Syncly’s Controls For “Do Not Track” Features?

Most web browsers and some mobile operating systems and mobile applications include a Do-Not_Track (“DNT”) feature or setting that you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice. 

8. How Will I Be Notified of Changes to Your Privacy Policy?

This Privacy Policy was effective as of March 31, 2021 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

If Syncly makes material changes to its Privacy Policy, it will notify you by: (i) changing the Effective Date at the top of the Privacy Policy, (ii) sending an email to all active account holders, and (iii) adding a statement to the Platform. Express consent will be obtained for any material changes in Syncly’s collection and use practices.

Our Service may contain links to other websites. These websites are not under our control and are not subject to our privacy notice. These websites and applications will likely have their own privacy notices. We have no responsibility for these websites and applications and we provide links to these websites and applications solely for your convenience. You acknowledge that your use of and access to these websites and applications are solely at your risk. It is your responsibility to check the privacy notices of these websites and applications to see how they treat your Personal Data.

10. Disclosures to Successors

If our business is sold or merges in whole or in part with another business that would become responsible for providing the Service to you, we retain the right to transfer your Personal Data to the new business. The new business would retain the right to use your Personal Data according to the terms of this privacy notice as well as to any changes to this privacy notice as instituted by the new business. We also retain the right to transfer your Personal Data if our company files for bankruptcy and some or all of our assets are sold to another individual or business.
